According to the results of the survey referred to in this article, almost a quarter of the hospitality employers surveyed are envisaging taking on younger workers to avoid paying the additional wages imposed by the National Living Wage (the "NLW").

From 1 April 2016, the NLW will introduce a new minimum wage of £7.20 per hour for over-25 year olds, which is 50p per hour more than the current minimum wage.

Purposefully employing younger workers ahead of older workers in order to avoid this expenditure could amount to age discrimination. It is therefore important to handle recruitment delicately and to take specific advice where necessary.
